ownership right of women

When the half continent of Arabic world was lightened by Islam, many changes occurred in women life and the rights that the time of ignorance had taken were given back them.

Before Islam the women were buried alive and were used as toys, but by appearance the Islam specified rights were given them and they benefitted as half part humanity from a proper respect.

Though unfortunately it is seen in some areas of Afghanistan that the rights of widow women are not being respected as Islam orders.

They are treated in an anti-Islamic manner in marriage, inheritance, family life and other parts which shows the defct of people and communities not Islam.

The Islam wants such a humanitarian community that should be free from all immoralities, this is possible only when the woman can have her position, rank, rights, incumbents; can know the area of working that she is not involved in snares of slaves of sensual wishes; so many holy verses of Quran and sayings of prophet Mohammad (PBUH) focuses on the issues related to women rights, their position and work.

All these shows that Islam has given special importance to women affairs because considering of the mentioned issues would cause the reforms in the community and not considering would put the community in corruption.

The constitution of Islamic Republic of Afghanistan also has been based on Islam, it respects the women’s rights based Islam’s order and is committed for safeguarding the women’s rights based Islam’s religion.

Ok dear countrymen! Now I would like to draw your attention to an interview that I Mohammad Nasim Lalahand prepared with Mawlawi Mohammad Sidiq Muslim the head of Judgment and Calculating Department of High Court regarding economic and ownership rights of women, in the beginning I have asked him what economic rights the women can benefit by Islam?

Answer: In the name of kind and almighty God! As Islamic history showed the Islam has had generally separated orders for different sides of humanitarian life, God has ordered frequently in Holy Quran as God says in a verse of Holy Quran “I have created the land for all of you”.

This is a specified religious and valuable partnership that Islam has specified equally for men and women that the men and women can benefit it, Islam always encourage us to work, Quran states in other verse, “there is nothing for human but its own endeavor” it means that nothing can be gotten in individual and social order without doing work, learning crafts, namely as much as you work you will get. God says “All humans must work and get economic value for them and others” though it differs that what works should be done by men and which by women, as all intellectual and physiologic values are divided and are proved based on intellectual standards in an Islamic community.

As the provision of alimony of a woman is the responsibility of her brother or her father and after her marriage would be responsibility of her husband, these all are for the sake that the woman should not be damaged by accomplishing onerous works rather she would be responsible to grow her children and would control the economic order in the family as Islam orders.

It also happens that the women should work like a man to meet her needs, the Islam has also ordered about, so if there is ground for women to work they can work separately or they can have unions of women that they can work in but they should work according to Islam’s order, God says “Whatever the man earns belongs to man and whatever woman gets belongs to the woman” so the mentioned verse proves that the income earned by women for meeting economic needs is the ownership of the woman and can use it properly, beside this there is the issue of inheritance for women in economic order as well.

Question: Before we start discussion on inheritance I have question that some people think that the woman neither should work nor study, they rationalizes that the providing of the alimony for women is the duty of father or brother before marriage and the duty of husband after marriage so what Islam says about?

Answer: Whatever Islam specifies and encourage the men for in its principles the same it specify and encourage the women as well though works are distributed in all types of communities including Islamic, infidel and discordant communities as in which field the man should work and in which field the woman should work considering the different conditions. .

You see the learning of science has been enacted as an incumbent on every man and woman and the women have been permitted to work based on economic needs and has been shown her right and legal whatever she earns to use though we should not forget that Islam has enacted different orders for needs and adornment of all people so when the need a woman is supported by somebody else so everyone should know that there is no need for woman to work.

It has also been proved that the woman that works without any need cannot support herself nor her family and children so the successful family is the one that have wise women and mother that can establish a strong family and strengthen the first school for the children.

Question: I meant that some men coerce their wives not work or study, so what is your view about?

Answer: Though the Holy Quran and sayings of prophet Mohammad (PBUH) has ordered all the Muslims on learning the science and work but it happens that even the men are not allowed to work so if the men don’t allow the women based Islam’s order it is fine for example if the security doesn’t exist or there is fear of ethical corruption and the insecurity and ethical corruption damage the women so in these cases the men can prevent the women and girl from working, there is a name for such a conditional called “ tool for prevention the damage” it means that the work is legal but this is not the man that doesn’t let the woman and girl to work rather the existence of damages prevent the woman and the girl to work or study so if these problems don’t exist no Muslim has the right to prevent the woman or girl from study and work.

The other problem regarding the work of women is that the women should be attired by natural beauty and adornment means they should not use decorative material of many factories to get artificial beauty and then sit beside the men, we all know in such a situation ethical corruption and deviation comes to existence, it has proved that wherever the men and women are working together in fact the graph of work is very low comparing to the places where only men or women are working.

Let us come to the issue of inheritance, God orders in Holly Quran “ whatever has remained from relatives and family of a man should be given to man whether it is less or much, whatever has remained from family or relatives of woman to a woman should be given whether it is less or much, this is the distribution of God”, this verse proves that the women as well as the men have the right of inheritance  but the women are deserving of half part of inheritance than men though is some cases they both get the equal inheritance, in some cases the women can get the whole inheritance , the mentioned all instances have been stated clearly in Sharia Law as the Muslims don’t know or they don’t obey this the problem of Muslims not problem of Islam because the Muslims have been guided clearly.

Giving of marriage-portion by the husband to wife during the matrimony/marriage is an obligation of the husband which proves the right of ownership of women; I hope all Muslims lead their communities and families by studying  deeply the Sharia Law that has been adorned by the verses of Holly Quran and sayings of prophet Mohammad (PUBH) in which all economic, social and educational orders have been stated clearly , by this we may have taken great steps toward solution of economic difficulties of the women.

Question: Thanks, as you told that Islam has given the right of ownership in marriage-portion and inheritance so when a woman gets income through a legal work has the man right to use the mentioned income?

Answer: God may keep you happy, it is a good question, when the capital belongs to woman so the loss and gain belongs to woman as well, as much as a woman earns through her business this is her right, she can continue her business and give to someone for limited partnership in this case the loss and gain will belong her, this is the right and ownership of the woman if the woman wants to give willingly something to her mother, brother, sister, offspring and husband from her economic ethical order, if she doesn’t want to give the capital belongs her , nobody has the right to interfere in her economic values, if the man want to get the easiest way would be this that  he should follow the order of Holly Quran which states, “ When a woman gives you willingly and happily eat it as an oily mouthful.”

So you should try to make your sister, mother and wife satisfied to help you happily and also you should use the given capital happily such as oily and delicious mouthful which neither cannot be stuck in your throat nor it is damaging for you otherwise the capital belongs to woman, she has the right of ownership no one has the right to interfere in her capital.

Question: If a woman shares her capital with her family to strengthen the order in the family without having satisfaction of the family so what would be the benefits by Islam?

Answer: Islam is a religion of love and honesty, if the woman shows such as honesty she would be happy and comfortable as well as her family and would cause the increment of the love and respect in the family, on the other hand this action would prevent indecent expense and would save the woman from selfishness and arrogance.

Question: So can I say that if the man and women consider all the mentioned points they would enjoy the life?

Answer: See when an individual order changes into social order willy-nilly the family would enjoy the life for example prayer is an individual incumbent but when it is accomplished in the mosque it changes into social order, someone may have private capital but when it shares its capital through alms, donations with others so it changes into social order, so if the man or woman want to enjoy the life it is always good to change their individual order into social order.

Question: Thanks for precious statements, what is your message to our countrymen?

Answer: I hope all Muslims specifically the Muslims of Afghanistan benefit the pulpits, theaters for passion plays, medias regarding restoring Islamic rights of women and eliminate all indecent and satanic systems as some people prevent the women from education, some people prevent them from work or some people deprive them from inheritance without knowing its legality or illegality, by this women would benefits all the rights that have been given by Islam.  The end.
